Privacy Policy
1. INTRODUCTION
The Laura and John Arnold Foundation™, also known as LJAF™, is committed to providing the Giving Library™ within a safe informational environment that balances obtaining certain information necessary to ensuring the good faith use of the Giving Library with safeguarding the privacy of the Giving Library’s users. This Privacy Policy describes LJAF’s collection and use of information. LJAF will not collect or use any information except in accordance with this Privacy Policy.
LJAF reserves the right to modify this Privacy Policy at any time. If LJAF makes material changes to this policy, LJAF will notify you by means of a notice on the Giving Library website. By continuing to use the Giving Library and Services after notice of changes has been so published, you are consenting to the changes.
2. INFORMATION COLLECTED
LJAF tracks user activity anonymously to develop analytics reports with respect to the Giving Library website. Specifically, the Giving Library website employs Google Analytics, which tracks usage using JavaScript. Further, LJAF divides the information it receives from and through its users into two general categories: (1) website usage information (“Website Information”); and (2) personally identifiable user information (“Personal Information”):
- a. Website Information
- i. Cookies
- LJAF may use “cookies” on or in connection with the Giving Library website to maintain information. A cookie is a very small text document or image file, which often includes an anonymous unique identifier. LJAF may use both “session” cookies and “persistent” cookies. A persistent cookie remains on your hard drive after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the Giving Library website. Persistent cookies can be removed by following your web browser’s directions. A session cookie is temporary and disappears after you close your browser.
- When you visit the Giving Library website, your computer may be asked for permission to employ the use of a session or persistent cookie. The Giving Library website will then send a cookie to your browser if your browser’s preferences allow it, but—to protect your privacy—your browser only permits the Giving Library website to access the cookies it has already sent to you and not the cookies sent to you by other websites.
- Most web browsers can be adjusted to inform you when a cookie has been sent to you and provide you with the opportunity to refuse that cookie. However, refusing a cookie may, in some cases, preclude you from using, or negatively impact the display or function of certain areas or features of the Giving Library website.
- ii. Clear GIFs
- LJAF may also use “Clear GIFs” (aka “web beacons” or “pixel tags”) or similar technologies in the Giving Library website and/or in its communications with you. A Clear GIF is typically a one-pixel, transparent image located on a web page or in an email or other type of message, which helps us to verify an individual’s viewing or receipt of a web page or message. LJAF uses information provided from Clear GIFs to enable more accurate reporting and better the Giving Library for its users.
- iii. IP Address & Clickstream Data
- LJAF collects information regarding the identity of your Internet Protocol (“IP”) address. LJAF uses this information for internal system monitoring and to administer the Giving Library website. This information may also be used to gather and aggregate broad demographic information and profile data.
- Identification of your IP address cannot be uploaded to the Giving Library website and is only held internally by LJAF. That is, no other user is able to learn your IP address through any permitted use of the Giving Library website.

- b. Personal Information
- The Giving Library includes the option of creating a user account. Creating a user-specific account requires the voluntary submission of certain personal information.
- Additionally, registration to use the Connection Center requests or requires, as the case may be, submission of the information below:
- Potential Philanthropist: user-created username, user-created password, email address, first name, last name, birth year, state of residence, profession, annual level of giving, income level, and identification of philanthropic interests.
- Nonprofit Organization: name of organization, full name of authorized representative, title of authorized representative, user-created username, user-created password, email address using domain of nonprofit organization and accessible by authorized representative, and phone number.
3. INFORMATION PROVIDED TO THIRD PARTIES
- a. Service Providers
- LJAF may use third-party partners to help LJAF operate and maintain the Giving Library website. Third-party service providers are contractually restricted from using or disclosing such information except as necessary to perform services on LJAF’s behalf or to comply with legal requirements.
- b. Aggregate Statistics
- LJAF may disclose non-personally identifiable aggregate statistics regarding user behavior as a measure of interest in, and use of the Giving Library website, such as overall patterns or demographic reports that do not describe or identify any individual user. Information relating to aggregate statistics may be collected through the use of third-party cookies and other third-party tracking devices.
- c. Legally Compelled Disclosures
- LJAF may disclose any information LJAF possesses as required to do so by law or subpoena or if LJAF believes that such action is necessary to (a) conform to the law, comply with a judicial or court order or comply with legal process served on us or related third parties; (b) protect and defend LJAF’s rights and property, the Giving Library website, the users of the Giving Library website, and/or related third parties; or (c) act under circumstances to protect the safety of users of the Giving Library website, LJAF, or third parties.
- d. Transfer
- LJAF reserves the right to transfer any obtained information LJAF in the event of merger or succession. Should such a transfer occur, LJAF will use reasonable efforts to direct the transferee to use personal information you have provided through the Giving Library website in a manner that is consistent with this Privacy Policy.
4. MINORS GUIDELINES
The Giving Library website is not directed to children under the age of 13, and LJAF does not knowingly collect personal information from children under the age of 13. If LJAF becomes aware that it has inadvertently received personal information from a visitor under the age of 13, LJAF will delete such information from its records.
5. CONSENT TO WORLDWIDE TRANSFER AND PROCESSING OF PERSONAL DATA
By using the Giving Library website, you agree that LJAF may collect, maintain, process and transfer the information described herein in and to the United States and other countries and territories, which may have different privacy laws from your country of residence and which may afford varying levels of protection. Regardless of the laws in place in these countries, LJAF will treat the privacy of such information in accordance with this Privacy Policy. By using the Giving Library website, you consent to LJAF’s transmission to, and processing of such information, in any jurisdiction in accordance with this Privacy Policy.
6. SECURITY
LJAF uses commercially reasonable and industry standard physical, managerial and technical safeguards to preserve the integrity and security of the information described herein. While LJAF endeavors to protect the security and integrity of such information, due to the inherent nature of the Internet as an open global communications vehicle, LJAF cannot guarantee that information, during transmission through the Internet or while stored on our systems or otherwise in our care, will be safe from intrusion by others, such as hackers. LJAF will have no liability for disclosure of such information due to errors or unauthorized acts of third parties.
